SFS Statement on the Biden Administration’s Attempt to Use March-In Rights to Seize Drug Patents

December 7, 2023 – The nonpartisan patient advocacy group Survivors for Solutions, founded by John “CZ” Czwartacki, an MS patient of 30 years, provided a statement on the Biden administration’s determination of authority to use march-in rights to seize drug patents:

“Just when we thought no more devastation could be done to the medical innovation ecosystem following the implementation of the Inflation Reduction Act, the Biden administration has crowned itself the authority to seize drugmaker’s patents. Bosting this will improve the drug ecosystem is unequivocally false, as it will dissuade scientists, doctors, and researchers from taking risks in their pursuit of breakthrough cures and cutting-edge treatments. If anything, we should make it more appealing for global capital and innovative research to pursue results in the US, not less.

At a time when our medical innovation system is booming, it’s unthinkable that our policymakers would not support the protections and innovators that could improve the life of patients. As someone who knows firsthand the hope a new drug or treatment can bring to a patient, I am continually disappointed with this administration’s healthcare “solutions” as they seem to only lead to less choice and less cures for patients like me.”
